English translation for information; the French version prevails.
Terms applicable to our workshop services, our parts sales and our online orders. They also appear on the back of our quotes and invoices.
Any order implies unreserved acceptance of these Terms, notwithstanding any contrary clause of the Customer. They govern all LNVI services and take precedence over any purchasing conditions of the Customer, unless LNVI agrees otherwise in writing. In case of contradiction, the front of the quote or invoice prevails.
Invoices are payable on the due date shown on the front, within the maximum legal deadlines (L441-10 French Commercial Code). No partial payment is discharging without written agreement.
Invoices are payable net, without discount.
Any delay automatically gives rise to penalties equal to three times the legal interest rate, which may not be lower than the ECB rate plus 10 points, until actual payment, in addition to the fixed indemnity of €40 (D441-5 French Commercial Code), without prejudice to further supporting claims.
The Repairer is only responsible for fitted accessories required for the work; items left in the vehicle remain in the Customer's custody. The anti-theft wheel nut key must be supplied; otherwise, a removal flat fee is charged, with no liability for the device.
The repair order binds the Customer and the Repairer. Lead times are indicative; exceeding them gives no right to compensation, cancellation or penalty, except in case of gross or wilful misconduct by LNVI. In case of force majeure (art. 1218 French Civil Code), obligations are suspended without compensation. The Customer collects the vehicle within 48 hours of invoicing; otherwise, storage fees apply. In case of breach by the Customer (non-payment, failure to provide information, refusal of an essential repair), the Repairer may suspend or terminate by operation of law, without compensation, with costs, diagnostics and immobilisation remaining due.
The Repairer is a stranger to any dispute between the Customer and its insurer; the Customer is liable for the full cost of the repairs. Road tests are part of the accepted work.
Any order may be partly firm and partly estimated. The invoice may vary by ±20% from the estimate; beyond that, the Customer's agreement is required (signature, stamp, email or SMS). The Repairer carries out the work necessary for safety, compliance or proper execution, even if not foreseen. Any diagnosis is due even if the work is subsequently refused. LNVI documents (quotes, repair orders, invoices, vouchers) are authoritative unless proved otherwise in writing and constitute the entire agreement, cancelling any prior agreement.
On express request on the repair order, replaced parts are returned, except for exchange units, deposit-bearing, warranty or hazardous parts. If not collected within 15 days, they are destroyed.
Special orders are firm and final. Standard parts are taken back within 15 days, with written agreement, in new condition and original packaging, with carriage and restocking at the Customer's expense. Claims for an apparent defect or a missing part: on the day of receipt; none accepted after 15 days.
10.1 Statutory warranties (hidden defects, conformity) are preserved. 10.2 LNVI contractual warranty: 12 months, limited to the exchange or restoration of the defective part; excluded: labour for removal/refitting, breakdown assistance, towing, immobilisation, loss of operations, indirect damage. 10.3 Conditions: proper use, compliance with LNVI recommendations, no unauthorised modification, payment in full. 10.4 Electrical parts: not taken back or exchanged; used or repaired parts: no warranty; warranty not transferable on resale; refusal of essential work limits the warranty. 10.5 Retention of title (art. 2367 et seq. French Civil Code, L624-16 French Commercial Code): goods remain the property of the Repairer until paid in full. 10.6 LNVI's liability, for all causes combined, is limited to the amount excluding VAT of the service, excluding loss of opportunity, financial or operating losses and indirect damage, except in case of gross or wilful misconduct and personal injury.
Any claim must be notified in writing within 15 days of collection. Any intervention by a third party before an adversarial expert assessment voids the warranty; assessments take place exclusively in our workshops, in the presence of our representative. A claim does not exempt the Customer from paying on the due date, unless ordered by a court. Only the Commercial Court of LNVI's registered office has jurisdiction, even in the case of multiple defendants.
Data is processed for the work, invoicing and warranties (GDPR EU 2016/679), kept for the statutory limitation period and may be shared with our factor and our insurers. Rights of access, rectification, objection and erasure.
In case of non-payment, LNVI retains the vehicle until payment in full.
LNVI collects and recycles oils, tyres, liquids, used parts and fluids; re-invoicing or eco-contribution applies.
LNVI may subcontract certain interventions (painting, bodywork, roadworthiness tests, type-approval inspections, lifting). LNVI remains the Customer's sole point of contact; its liability for these services is exercised within the limits and caps of Article 10.
LNVI may assign its receivables by subrogation to its factor. After notification shown on the invoice, only payment to the designated assignee is discharging; the Customer follows the payment instructions on each invoice.
Account opening and the credit limit granted are subject to the approval of our credit insurer. LNVI may at any time reduce or suspend the credit limit, require cash payment or guarantees, in particular in the event of a payment incident or deterioration of the Customer's solvency.
For any new customer or first intervention, payment is due in cash on collection of the vehicle. LNVI may require a deposit before ordering special parts.
Any electronic validation by the Customer (signature, tick box or agreement on receipt of the vehicle) constitutes a firm repair order and acceptance of the order and of these Terms, and is equivalent to a handwritten signature (art. 1366-1367 French Civil Code); the Customer may not dispute its existence. The contract is governed by French law, the French version alone being authoritative.
Any tolerance or postponement by LNVI constitutes neither novation nor waiver of the right to rely on these Terms.
Fixed-price services booked and paid for on lnvi.fr constitute a firm order within the meaning of Article 7, for the scope described on the service page on the day of the order; anything outside that scope falls under Article 7 (prior agreement of the Customer). Payment is made in full at the time of the order via LNVI's secure payment provider, which has no access to the Customer's bank details. The chosen slot is confirmed by LNVI within 2 business hours; it can be postponed on request sent to LNVI before the day of the intervention. The information declared at the time of the order (vehicle, size, registration, company) binds the Customer and is checked on receipt of the vehicle; in case of discrepancy, Article 7 applies, the amount paid remaining acquired and being deducted from the service selected. By validating the order, the Customer expressly requests that the service be performed from the booked slot, including before the expiry of any withdrawal period that may exceptionally apply, a right which the Customer waives once the service has been fully performed; the Bilan 360 is deemed fully performed upon delivery of the report.
